Operating Name: AGNT Real Estate Media (Brisbane Photo Services Pty Ltd)
Location: Brisbane, Queensland, Australia
Last Updated: May 2026
1.1 Ownership: The Photographer retains full, exclusive copyright and intellectual property rights for all images, video footage, floorplans, and drone media (the "Media") created during the assignment.
1.2 License to Client: Upon receipt of full payment, the Photographer grants the Client (the hiring Agent or Agency) a non-exclusive, non-transferable, limited license to use the Media solely for the marketing, advertising, and sale/lease of the specific property listed.
1.3 Expiration & Third-Party Restrictions: This license automatically expires once the property is sold, leased, or the listing agreement is terminated. The Client must not sell, lease, transfer, or gift the Media to any third party—including incoming real estate agents, builders, interior designers, staging companies, or the property owner—without the prior written consent of, and additional licensing fee paid to, the Photographer.
2.1 Payment Window: Invoices are issued on the day the finalised assets are delivered. Payment is strictly due within seven (7) days from the invoice issue date.
2.2 Late Payment & License Suspension: If payment is not received within 7 days, the marketing usage license granted in Clause 1.2 is automatically suspended. Continued use or publication of the media while an invoice remains overdue constitutes a breach of copyright. The Photographer reserves the right to charge a late fee of $25 AUD per month on all overdue balances.
3.1 Creative Discretion & Briefing: Video production will be executed according to the Photographer's professional creative style. Any specific style guides, branding assets, or musical preferences must be provided by the Client in writing prior to the shoot.
3.2 Revisions: The package price includes two (2) rounds of minor edits (e.g., swapping a clip or adjusting text). Requests for minor edits must be submitted within 72 hours of video delivery. Major structural changes, or edits requested after this period, will be billed at an hourly rate of $40 AUD/hour or part thereof.
3.3 Audio Licensing: All background music used in video production is legally licensed by the Photographer for real estate marketing purposes. The Client must not replace or alter the audio track without verifying third-party copyright permissions.
4.1 Regulatory Compliance: Drone operations are conducted strictly in accordance with the Civil Aviation Safety Authority (CASA) regulations and standard operating conditions.
4.2 Safety & Pilot Supremacy: The Pilot in Command (the Photographer) maintains absolute authority over all drone flight decisions. The Pilot reserves the right to cancel, alter, or suspend any flight if conditions pose a risk to safety, personnel, aircraft, or third-party property.
4.3 Restricted Flight & Weather: If drone flights are restricted due to weather (e.g., high winds, rain), controlled airspace boundaries, or populous area hazards, the Photographer is not liable for missing aerial assets. Ground-based photography will still proceed, and drone services will be rescheduled or refunded on a pro-rata basis.
5.1 Illustrative Purposes Only: Floor plans are created as a visual aid for marketing purposes only and are not architectural blueprints or surveyor-grade plans.
5.2 Accuracy Disclaimer: While all care is taken to ensure accuracy, all measurements, dimensions, layouts, and window/door placements are approximate. The Photographer accepts no liability for errors, omissions, or financial losses incurred by the Client, property owner, or buyers relying on the floor plan. The Client must include a standard disclaimer on the published floor plan stating: "Measurements are approximate and for illustrative purposes only."
6.1 Scale and Proportions: Digitally added furniture and fixtures will be scaled as accurately as possible to reflect the true dimensions of the room. The Photographer is not responsible if a buyer's physical furniture does not fit the space.
6.2 Misleading Advertising Compliance: In accordance with the Competition and Consumer Act 2010 (Cth) and Queensland Office of Fair Trading guidelines, virtual staging must not hide structural damage, permanent defects, or unpleasant views.
6.3 Client Disclosure Obligation: The Client acknowledges that Queensland consumer laws require transparent property listings. The Client must clearly label any virtually staged images with text such as "Virtually Staged" or "Indicative Images Only" when publishing them online or in print to avoid misleading prospective buyers.
7.1 Legal Access: The Client warrants that they have lawful permission and have provided all necessary legal notices (e.g., RTA Form 9 - Entry Notice) to access the property for photography.
7.2 Tenant Belongings & Privacy (Rental Properties): Under the Residential Tenancies and Rooming Accommodation Act 2008 (QLD), if the property is currently tenanted, the Client must obtain written consent from the tenant before the Photographer can capture or publish images displaying the tenant’s personal belongings (including furniture, vehicles, and photos). The Photographer accepts no liability for privacy breaches resulting from the Client’s failure to secure this written consent.
8.1 Property Condition: The property must be clean, decluttered, and staged prior to the Photographer’s scheduled arrival time. The Photographer is not responsible for cleaning, moving heavy furniture, or tidying spaces.
9.1 Cancellation Notice: Notice of cancellation or rescheduling must be given at least 24 hours prior to the scheduled shoot time. Cancellations made inside this 24-hour window may incur a Cancellation Fee of $95 AUD.
9.2 Unready / Locked Property: If the Photographer arrives at the scheduled time and cannot gain entry, or if the property is completely unready to be shot, a Lockout/Call-Out Fee of $95 AUD may apply, and the session must be rescheduled.
10.1 Insurance: The Photographer maintains a current Public Liability Insurance policy to the value of $10,000,000 covering commercial and aerial operations.
10.2 Indemnity: The Photographer takes all reasonable care on-site but is not liable for accidental damage to the property or items unless caused by gross negligence. The Photographer’s total financial liability for any claim arising out of this agreement shall not exceed the total amount paid by the Client for the specific booking.
